Policies

By attending a San Jose Bird Mart, all vendors agree to abide by these Policies,
whether or not there is a signed Application on file.

Early-pay Discount

• Discounted pricing that applies when the application is paid in full at the previous bird mart, regardless of the date.
• Due to an increase in building rent, spaces ordered within 14 days of a show will cost more. Early-pay discounts still apply.
• Payment is due by 3:30pm on show day. Payments received after 3:31pm on show day will be charged at a higher price.
• If you are unable to attend the mart, payment must be received prior to mart day.

Security Measures

• Security wristbands and hand stamps are worn by all members of the public.
• Anyone without a wristband or handstamp must be escorted to the front door.
• The public may only enter the building from 9am-3pm on mart day.
• The public may not be inside the building outside these hours.
• If sales are conducted outside these hours, and the customer is not wearing a wristband or a handstamp, the vendor will be cited a $50 fine per incident.
• If a vendor invites a customer inside the building (who has not paid), the vendor will be cited a fine of $100 per incident.
• Two wristbands will be provided for the first space, and one additional band for each additional space. Additional bands can be purchased for $5.
• Bands are provided for people working in the booths. Visiting friends will be expected to purchase a band.

Space Cancellation

To avoid any confusion in the future, the San Jose Bird Mart has developed a Cancellation Policy, effective immediately. All vendors, by signing the Application, and/or by ordering spaces verbally or otherwise, agree to abide by all of the Policies as stated on this page, and on the Application.

1. If you do not attend a Bird Mart after you have paid for a space, it is considered a cancellation, regardless of the circumstances.
2. If you pay for a space, and you do not attend the Bird Mart, you may lose some money depending on when you cancel (see the Space Refunds).
3. You may qualify for a refund, or some of your money may be credited towards the next Bird Mart (see the Space Refunds).

Verbal Orders

1. If you order space verbally, over the phone, or via email, and those spaces are reserved for you, you are obligated to pay for them, whether or not you show up for the mart. If you cancel or don't show up, you will be billed for those spaces.
2. Fees for cancelled spaces are due and payable immediately.

*If we are unable to sell your space, you will forfeit 100% of your money, you will not receive a refund, and no money will go towards the next Bird Mart.

Refunds are processed and mailed within 30 days of a qualifying event.

Table/Chair Orders

We often order tables and chairs from outside vendors. We pay for tables, chairs, delivery, and pick-up. Therefore, we do not order extras. The following rules are effective immediately.

1. Tables and chairs must be ordered before 14 days prior to the show.
2. Any tables/chairs ordered after the early-pay (after 3:30pm of the previous show date) will incur a higher rate (see the Application).
3. Table and chair orders cannot be changed within 14 days of a show.
4. Cancellations of table/chair orders within 14 days of a show will be charged the full rental amount.
5. If tables/chairs are ordered within 14 days of a show, and a cancellation occurs, you will be billed at the higher rate.
6. Table/chair orders are treated separately from spaces and refunds do not apply.
